"state secrets" privilege
President Bush used a tactic called rendition, or removing prisoners suspected of being terrorists from American-run prisons secretly to foreign prisons where torture is not outlawed. The ACLU has sued on behalf of people who were treated this way, but the Obama administration is refusing to turn over documents or give testimony about it, based on the fact that they're state secrets.
